ParkCreek Surgery Center and an affiliate, Delray Beach Surgery Center, both free-standing, multi-specialty, fully AHCA licensed, Medicare Certified and AAAHC accredited Ambulatory Surgical Center s(ASC), have an immediate opening for a seasoned "hands-on", full-time, staff attorney.  This is a one-person position that is physically located at ParkCreek, which is in Northwestern Broward County, 2 miles south of Boca Raton/Palm Beach County.  Centers are the official ambulatory surgical centers of the NHL Panthers!  Specialties  include, extremity and hand orthopedics, spine, ophthalmology (cataract and retinal), pain management, podiatry, general surgery, urology, gynecology, plastics reconstruction, ENT and gastroenterology.  Centers are physician partnerships that are professionally managed by highly experienced health care executives.  The ParkCreek ASC is in its sixth year of business and the Delray Beach ASC is in its seventh year of business.  Both are profitable businesses.  
This position will be an employee as staff counsel, not independent contractor, entitled to company paid benefits, support the Business Office, and report to the Centers' Administration. 

This is a multi-faceted position with a job description that includes, but is not limited to: 

Work with Business Office staff to assure that the Centers are optimizing its net revenue per case potential, while reducing its days of revenue outstanding;
At time of settlements or awards, be point person for both surgical centers with respect to negotiation with PI attorneys and their paralegals who represent accident victims for whom facility surgical services were rendered by our surgical center(s) pursuant to contingent fee LOP/Lien agreements; 
Work with third party payers/managed care plans to resolve continual contractual and coding interpretations and reinterpretations made by the payers to the detriment of the Surgical Centers, as related to reimbursements made to the Centers under its contracts with payers, insurance plans, PPO networks and attorneys' "letter of protection;
Work with third-party payers/managed care plans and their agents to increase reimbursements made to Centers as "out-of-network" ASC providers;
Negotiate and renegotiate the Centers' managed care and insurance plan contracts, to assure highest level of reimbursement and compliance with payment protocols associated with claims adjudications performed by payers;
Prepare and file motions, petitions and/or file litigation against delinquent patients, as well as attend all associated hearings, to obtain monies due to Centers from such patients, third-party payers and attorneys/patients who execute "letters of protection" with Centers;
Draft and file workers' compensation appeals and petitions on a timely basis on behalf of Centers; and
Be in-house lawyer and compliance officer, to include HIPAA, interface with outside counsel for all malpractice actions and depositions, and with Risk Management with involvement of all potential and reportable events.

Draft protective orders and other associated documents, and appear at court hearings (as needed) in response to subpoenas received by Centers from attorneys representing plaintiff insurance companies associated with personal injury patients accepted by Center.

Education, training, experience:
The ideal candidate must  have a law degree, Florida license, admitted to US District Court for Southern Florida, experience, including court room litigation, contract review and drafting and negotiated PI settlements.  Added experience with the following would be bonus: "hands on" operations experience of business office functions of physicians, outpatient hospitals and/or licensed ambulatory surgery centers, to include coding, billing, and accounts receivable management.  

Specifically, the requirements for this position are: 

Degreed/Florida licensed attorney, admitted to US District Court for Southern Florida, preferably with at least 5 and preferably 10 years minimum with experience as  licensed attorney with collections, commercial litigation, contract drafting and and associated negotiations, as well as negotiated PI settlements a real plus!.  Candidates with health care experience would be a real plus.
Excellent analytical, negotiating and writing skills necessary, to include expert use of Word and Excel. Must be proficient at drafting and filing complaints, attending courtroom proceedings to obtain legal judgements against patients whose accounts are delinquent, as well as settlement negotiations. 

Member of Florida Bar required with admittance to US District Court for Southern Florida.
